Ideal candidate will be tasked with representing clients involved in various transportation-related incidents, including auto accidents, tractor/trailer collisions, bus accidents, crane mishaps, dump truck incidents, fatalities, traumatic brain injuries (TBI), and motor vehicle accidents (MVA). The candidate will provide comprehensive legal counsel and defense strategies to individuals, businesses, and insurance companies operating within the transportation and trucking industry. The candidates' responsibilities will encompass various tasks, including conducting thorough investigations into accidents, analyzing evidence, assessing liability, and developing defense strategies tailored to each case's unique circumstances. The candidate will also represent clients in negotiations, mediation, and court proceedings. The candidate should be comfortable with insurance defense and company guidelines. Our attorneys are actively involved in professional organizations such as TIDA (Trucking Insurance Defense Association), DRI (Defense Research Institute), TLA (Transportation Lawyers Association), TADC (Texas Association of Defense Counsel), and CLM (Claims and Litigation Management Association), which should guide you in your search. - Transportation Laws and Regulations – The candidate will need a deep understanding of federal and state transportation laws, including those enforced by the Department of Transportation (DOT). This includes regulations on driver hours, vehicle maintenance, weight limits, and hazardous materials transportation.
- Accident Investigation and Reconstruction – The candidate will work closely with accident reconstruction experts to analyze the circumstances surrounding commercial truck accidents.
- Insurance Coverage Issues – The candidate may handle disputes over insurance coverage. This may involve interpreting insurance policies, negotiating with insurers, and representing clients in coverage litigation. We understand that coverage is a niche area, but this will make the candidate even more robust if they have some experience here.
- Dram Shop Cases – If alcohol is involved in an accident, the candidate may defend trucking companies or other parties against dram shop liability claims.
- Driver Misconduct or Non-Compliance – The candidate may address cases where truck drivers violate company policies or regulatory requirements, such as carrying unauthorized passengers or failing to adhere to safety protocols. This may involve conducting internal investigations, representing clients in disciplinary hearings, and mitigating reputational damage.
- Corporate Representative Depositions – The candidate will prepare and defend corporate representatives during depositions, where they may be questioned about company policies, training procedures, and compliance efforts. Your role is to protect the company’s interests while maintaining transparency and credibility.
- Risk Management and Compliance Counseling – The candidate will provide legal guidance to trucking companies on risk management strategies, compliance with safety regulations, and best practices for minimizing liability exposure.
- Litigation Defense and Settlement Negotiation – The candidate will represent clients in lawsuits arising from accidents or other transportation-related incidents. This involves crafting legal arguments, conducting discovery, engaging in settlement negotiations, and advocating for your clients in court if necessary.
